Redistribution of Commodities

    We are a food bank and we deliver TEFAP to agencies who then run quarterly distributions. Sometimes agencies do not want or can not distribute all the food. What should be done with these items/cases/pallets? 

    Can the food be donated to area pantries? If so, is it treated as donated food to the pantry or as TEFAP food needing Self-Declaration form?

    Can the food bank redistribute through the pantry TEFAP program?

    What record keeping involved?

    Thank you for your question!

    States have the flexibility to determine what direction they will take on the federal guidance with regards to the redistribution of TEFAP product. All TEFAP must be distributed through approved sub- recipient agencies. We have consulted with the current holder of the TEFAP contract in Michigan and their response was, -the transfer of the food from one sub-recipient agency to another must be approved by Michigan Department of Education.
